Gov’t pushes crackdown on porno

The Hayden Kho-Katrina Halili sex video scandal may have brought to the fore a “social menace” but the government is also looking at the issue as a silver lining to strengthen laws against pornography, voyeurism and obscenity in the country.

“If there’s anything good that can come out of all this controversy, this has highlighted the need for our lawmakers to really look into legislation that can effectively control or regulate the Internet involving cyber sex,” Press Secretary Cerge Remonde said Saturday.

Remonde also stressed the role of parents in providing supervision to their children, especially when it comes to combating pornography or exploring pornographic materials.

Published reports revealed that bills against video and image voyeurism, child pornography, obscenity and porno are yet to be approved by the Senate.

“We trust the distinguished senators who are directly elected by the people and have the responsibility to the people. We still trust the leadership of the Senate and the Senate President, Juan Ponce Enrile. In fairness to him, since he became Senate President, he has demonstrated and have disposed important cases of the administration,” Remonde said.

“We trust that he will be able to handle these matters,” he added.

The Press Secretary earlier said that President Arroyo called for a stronger legislation regulating the Internet for the protection of public morals, adding that the president deplores any violation of women’s rights.

Remonde said the President has already ordered the Optical Media Board (OMB) and other government agencies to beef up their government campaigns against pornography.

House sets inquiry on sex video scandal despite an apology from celebrity doctor Hayden Kho, the House of Representatives will pursue its own inquiry into the sex video scandal involving him, actress Katrina Halili and possibly others.

Speaker Prospero C. Nograles said the House will give priority to the probe in deference to its more than 50 female members, who have been “disturbed” by the proliferation of a video showing Kho in bed with different women, including Halili.

“The House will give this top priority especially that there are so many women members of Congress,” the House leader said.

Nograles said the House has the duty to probe any “psychological violence and abuse against women and the privacy of their rights and the scheme they had to go through.”

Earlier, Gabriela Reps. Liza Maza and Luz Ilagan filed House Resolution 1184 directing three House committees to inquire into how the right to privacy can best be protected in the light of the latest video sex scandal involving Kho.

Kho already virtually admitted that he videotaped his sexual encounters with women without their knowledge and consent, and apologized for doing it.

Maza and Ilagan said the House should conduct an inquiry, in aid of legislation, to prevent the occurrence of similar incidents in the future.

Halili, the aggrieved actress in the video, said that she will pursue a case of psychological violence under the Section 5 of the Women and Children’s Welfare Act against Kho even as the controversial doctor and his girlfriend, cosmetic surgeon Dr. Vicki Belo, are set to file next week their counter-affidavits on the complaint filed by the actress, National Bureau of Investigation (NBI) Assistant Regional Director Vicente de Guzman III, chief of the Anti-Fraud and Computer Crimes Division, said Saturday.

De Guzman said that engineer Ric Johnston Chua is expected to appear Monday before the NBI to answer allegations that he reproduced the sex video on Kho and Halili and allegedly uploaded it in the Internet.

Kho and Belo of the Belo Medical Clinic were summoned by the NBI to appear before the NBI last Friday after a complaint was filed by Halili against Kho but the two doctors did not appear and instead sent their lawyers, Peter John Javier, Jose Paolo A. Patajo and two other lawyers to face the investigators.

The lawyers of Kho and Belo said the two doctors would file their counter affidavit this week.

De Guzman said Chua also failed to appear at the NBI last Friday but said that he has hired a lawyer who asked for a time to study the matter.

Katrina Halili is an alumna of the StarStruck talent search and the cover girl of leading magazines such as FHM and Maxim Philippines. She was voted as FHM Philippines' sexiest woman for the year 2006 and bagged the title yet again in 2007. She is the first StarStruck contestant to top the FHM Philippines' 100 Sexiest list and the only Filipina celebrity to have won the title twice in a row. She is a three-time FHM Philippines covergirl.[1] With 123,000 votes, she placed 2nd in 2008 next to Marian Rivera.

In May 2009, three videos [2] that shows compromising encounters between Halili and Dr. Hayden Kho were distributed over the internet without her consent.[3] It was supposed that the person behind the leak of the videos to Internet was a certain Eric Chua, a close friend of Hayden Kho.[4] Sen. Ramon Revilla Jr., in his privilege speech, denounced Kho's acts and would file a case for the removal of Dr. Kho's license.[5] She is also consulting with the women's rights group GABRIELA regarding the legal actions that will be placed against Kho.[6]

Dr Hayden Kho dapat makulong - solons



Sa panayam ng media nitong Miyerkules, nanawagan sina Reps. Rufus Rodriguez (Cagayan de Oro City) at Irwin Tieng (Party-list Buhay), sa mga kapwa mambabatas na apurahin ang pagpasa ng panukalang batas na magpapataw ng parusa sa mga gumagawa at nagpapakalat ng video sex scandal.

“Aside from revoking his license, he should go to jail," direktang pahayag ni Rodriguez sa mga mamamahayag.

Sinabi ni Rodriguez na mayroon siyang kababayan na nagsabing naging “biktima" rin siya ni Kho.

“I will take the cause of my constituent; I’m just trying to get the details," ayon sa kongresista.

“Since he’s (Kho) a doctor he should be the least person to do this wrong, immoral and illegal act. We have to make sure that the full force of the law is imposed on him," idinagdag niya.

Nangangamba naman si Tieng na makalusot sa pananagutan sa batas si Kho dahil walang batas sa kasalukuyan na direktang nagpaparusa sa mga nagkakasala tulad ng ginawa umano ni Kho na nag-video sa ginawa nitong pakikipagtalik.

Kabilang si Tieng sa mga mambabatas na naghain ng panukalang batas laban sa pagkuha ng larawan o video sa mga pribadong tagpo tulad ng pagtatalik at pagpapakalat nito sa Internet at iba pang paraan.

Ang mga lalabag sa panukala ni Tieng na “Anti Cyber-Boso bill," ay maaaring makulong ng hanggang anim na taon at multa na hanggang P500,000.

“We believe that if passed, the proposed law will not only serve as a strong deterrent, but remind one and all – specially the children – that the video-taking of their private acts is not only immoral but illegal," pahayag ng kongresista.

May hiwalay na panukala na inihain si Rodriguez na tinawag na “Anti-Voyeurism Act," na pirmado na umano ng iba pang mambabatas.

Bukod sa usaping legal, sinabi ni Zambales Rep. Ma. Milagros Magsaysay na ang pagkalat ng mga sex video scandal ay sumasalamin na rin sa moral values ng bagong henerasyon.

Ang nangyari umano kay Katrina ay dapat maging panggising sa mga magulang upang bantayan at gabayan ng mabuti ang kanilang mga anak.

Umapela naman sa publiko si Tieng na huwag ng ipakalat ang sex video bilang suporta kay Halili at nang hindi na mapanood ng mga minor de edad.

"People are falling over themselves talking, downloading, and watching the Halili-Kho video flicks. These talks - along with discussion in the media - is bound to arouse children's interest and curiosity on the matter," ayon sa kongresista.

Lawmaker's worry: Gov’t might use sex scandals to impose severe Internet censorship

Voyeurs and businessmen are not the only ones that could take advantage of the proliferation of sex scandals involving celebrities in the Internet - it could also benefit a government that wants to muzzle its citizens.


Thus said Kabataan partylist representative Mong Palatino as he urged the public, especially the youth, to be circumspect in using the Net so as not to give the government a reason to restrict its citizens’ rights.

“The Internet is a very strong medium of information dissemination among the youth, and we would all do good to use it for purposes that do not intend to maliciously malign possible victims of sexual exploitation," Palatino said in a statement.

“Also, let us not give the government reason to further restrict our rights and freedom of expression. These recent YouTube scandals might give them reason to impose severe censorship even in the Internet," he added.

Palatino’s remark came amid criticisms against embattled doctor-turned-celebrity Hayden Kho for his sex videos with different celebrities, including Katrina Halili.

Kho’s videos, which were reportedly filmed without the girls’ knowledge, are now all over the Net and underground markets, prompting politicians, feminists, and doctors to call for the revocation his license.

Anti-voyeurism bill filed in Senate


Aware that technology could be misused and result in the "invasion of one’s private acts,’’ Senator Pia Cayetano has filed a bill that seeks to prohibit and penalize the recording of private acts as well as of the distribution or exhibition of such recordings without the consent of the person involved.

Cayetano filed the proposed Anti-Video Voyeurism Act of 2009’ on Wednesday, a day after Senator Ramon "Bong’’ Revillar Jr. exposed sex videos shot by Doctor Hayden Kho with television actress Katrina Halili and other women.

In pushing for the immediate passage of her measure, Cayetano said many women caught in sex scandals on the Internet and mobile phones have been "doubly’’ victimized.

"First, when the recording was made without their consent and second, when such recording was viewed again and again,’’ Cayetano said in an explanatory note on Senate Bill 3267.

She said that such violations were "considered the highest form of violation to the privacy of the offended person.’’

"Such violation is condemnable and needs to be penalized in its highest degree,’’ Cayetano said.

Under the bill, it will be unlawful for any person to record or attempt to record any private acts, including but not limited to sexual acts, without the consent of all the concerned parties.

It will also be unlawful for any person to "knowingly possess’’ any video tape, disc or any such record or their copies, "with the intent to share, relay or exhibit the contents.’’

The bill also bars a person from sharing or exhibiting these records.

If passed into law in its present form, violators will be punished with jail terms of not less than six months or more than six years and a fine of P100,000 but not more than P500,000.

3-pronged probe, wiretapping charges loom vs Hayden Kho

A three-pronged probe by the Philippine Medical Association (PMA) and possible wiretap charges await celebrity doctor Hayden Kho over his sex videos posted online.


PMA spokesman Bu Castro said in a radio interview the PMA has formed a committee to look into the claims against Kho for conduct unbecoming of a doctor.

"Binigayang pansin ito at bubuo ng committee para dito para tingnan… sana nga makipag-cooperate ang nandoon. Subali't titingnan namin ang info na aming makakalap hanggang sa exact facts. Minsan iba-ibang source ang aming kinukunan may sariling opinion. Kung siya mismo magbigay sa amin parte ng babae at parte ng lalaki," Castro said in an interview on dzXL radio.

[We have taken notice of this and we will form a committee to investigate this. We hope they will cooperate. We want to get the facts firsthand, not based on secondhand accounts. We hope he will give us the lowdown on what happened.]

Castro said the investigation would focus on whether Halili was a patient of Kho; whether their relationship was private; and if Kho was indeed the one who distributed the video.

Halili had admitted having a short fling with Kho and had apologized publicly for it.

"Ang tanong namin dito, pasyente ba ni Hayden si Katrina Halili o ibang partner niya? ... Ito ba may private relationship? ... At pangatlo kung private at di pasyente, sya ba talaga nagkalat nito? Yan ang gusto namin malaman,"he said.

[Is Halili a patient of Kho? Is their relationship private? Was Kho indeed the one who circulated the video? Those are questions we want answered.]

He admitted the PMA was "forced" to come up with its own investigation after noticing the furor caused by the sex video scandal.

Castro also noted reports that the video of Kho with other women had begun circulating.

He said that at the (PMA) convention at Shangri-La, the video was discussed, and that the participants were forced to act on the matter, he said.

Wiretapping case?

On Tuesday, Sen. Ramon Revilla Jr. denounced Kho for posting on the Web his sex video with actress-model Katrina Irene Pe Halili.

Halili lodged a complaint against Kho before the National Bureau of Investigation (NBI) Wednesday.

Meanwhile, Justice Secretary Raul Gonzalez said Kho faces charges for violating the Anti-Wiretapping Law.

"It shall also be unlawful for any person, be he a participant or not in the act or acts penalized in the next preceding sentence, to knowingly possess any tape record, wire record, disc record, or any other such record, or copies thereof, of any communication or spoken word secured either before or after the effective date of this Act in the manner prohibited by this law; or to replay the same for any other person or persons; or to communicate the contents thereof, either verbally or in writing, or to furnish transcriptions thereof, whether complete or partial, to any other person: Provided, That the use of such record or any copies thereof as evidence in any civil, criminal investigation or trial of offenses mentioned in Sec. 3 hereof, shall not be covered by this prohibition.," Section 1 of Republic Act 4200 states.

Gonzalez, in a separate interview on dzXL, added he was waiting for Halili to complete her statement before the NBI.

"Babalik siya sa NBI ngayon para tapusin ang kanilang pagbigay ng statement. Pagkatapos it will be submitted to me, I will order an investigation [She is to return Thursday to finish her statement. After that, it will be submitted to me, and I will order an investigation]," he said.

Mounting criticisms

For his part, PMA president Dr. Rey Melchor Santos said the medical community condemns the videos, which he said could tarnish the reputation of the medical profession.

“Wala pong doktor na natutuwa sa nangyari. Nakasisira ito sa aming propesyon [No one among my colleagues is happy over what happened. This could damage the reputation of our profession]," Santos said in an interview on dzBB radio on Thursday.

No less than Malacañang joined lawmakers and government officials in denouncing Kho’s supposed clandestine manner of taking the videos, which are now making rounds in cyberspace.

Santos added that while they would prefer Kho’s “victims" to lodge a complaint against the controversial doctor, the PMA could start its own investigation to determine whether Kho is ethically liable.

“Mayroon kaming Commission on Ethics na magco-conduct ng hearing. Mas maganda kung mayroong complainant…Pwedeng mag-conduct ang PMA, motu proprio. We want to self regulate, hindi pwedeng i-allow ito (na) sisira sa dignidad ng medical profession," Santos said.

[We have a Commission on Ethics that could look into the matter, although we would prefer if there is a complainant. The PMA could conduct an inquiry on its own initiative. We want to self-regulate. We cannot allow anything that could taint our image.]

Still, the Professional Regulation Commission (PRC) could penalize Kho and revoke his license if proven that he committed wrongdoing.

In a separate dzBB interview on Thursday, PRC chairperson Nicolas Lapeña Jr. said the investigation on Kho falls under ambit of the Board of Medical Examiners and the PMA and that the PRC would act on their recommendations.

“Sila muna ang gagawa ng investigation at kung anuman ang resulta nun, saka lang i-aakyat sa PRC [The Board and the PMA would conduct the probe, whose results would be elevated to the PRC]," Lapeña said.

MANILA, Philippines - Finding himself in the center of a raging controversy over his sex videos with model-actress Katrina Halili and two other women, celebrity cosmetic surgeon Hayden Kho is expected to appear at the National Bureau of Investigation (NBI) today to explain his side on the controversy, which may cost him his profession and even his freedom.

The NBI issued a subpoena that also covers Kho’s girlfriend Dr. Vicki Belo, also a prominent cosmetic surgeon.

The sex videos have spread on the Internet and DVD copies are bestsellers in many shops in Quiapo.

NBI Director Nestor Mantaring said at a press conference yesterday that a certain Dr. Eric Chua could be one of those who uploaded the videos on YouTube.

“We will summon him. But we have to summon first Dr. Hayden Kho,” Mantaring said.

He said Kho and Belo have just returned from a trip to Japan.

Optical Media Board chairman Edu Manzano said Chua was a fraternity brother of Kho but they allegedly had a falling out. Manzano said they received a tip on the existence of the video last month and that someone was trying to sell the video to producers for P20 million, but he did not say if it was Chua.

“He (Chua) was mentioned in a text message which was received by the manager of Katrina, saying he (Chua) has something to do with the copy of the footage,” Vicente de Guzman III, chief of the Anti-Fraud and Computer Crimes Division of the NBI, said.

“On Dr. Vicki Belo, we have to ask her also how she got a copy of this sex video,” De Guzman said.

“Our target now is to identify who uploaded the video on the Internet. This investigation would not take long since the personalities have already been identified,” he said.

Kho is scheduled to appear at the NBI at 10:30 a.m. and Belo at 1:30 p.m.

De Guzman said, so far, the NBI is looking into Kho’s possible violation of Article 9262 or the law on Crimes Against Women and Children.

Halili, accompanied by Sen. Ramon “Bong” Revilla Jr., on Wednesday filed a complaint against Kho with the NBI.

In an earlier privilege speech entitled “A Doctor’s Perversity,” Revilla lambasted Kho for the sex videos and called on the Philippine Medical Association to revoke his license.

“(It is) a clear case of violation of a woman’s privacy and dignity,” said Human Rights Commission chairman Leila de Lima. “The posting (of the video) was clearly malicious,” she said.

“I hate to say this, but Filipino women clearly do not get enough respect. If Filipino men do not respect Filipino women, how can we expect a human rights culture in a world where our women, including migrant workers, will get respect?”

Association of Major Religious Superiors of the Philippines (AMRSP) co-chair Sister Mary John Mananzan also said Kho should not go unpunished.

“Even if they were consenting adults it does not mean that they should announce to the world what they did. I do not know what legal recourse can be done but this was really extreme. It really demeaned people and reduced them to the level of objects,” Emeritus Novaliches Bishop Teodoro Bacani said.

“We give Katrina our support and we vow to promote every measure to protect and defend women like her (who have been) degraded and humiliated by this kind of malicious act,” Gabriela party-list Rep. Liza Maza said in a statement.

PNP offers help

Amid the outrage over the spread of the sex videos, the Philippine National Police (PNP) said it is ready to help Halili find justice.

“The PNP will offer or give assistance to those in need of investigation, those who are filing complaints, and those who are in need of security,” PNP Director General Jesus Verzosa said in an interview.

“The PNP will attend to any concern or complaint. We do not discriminate. If there is a complaint we investigate, and if there is a request for security and request for investigation, we will investigate,” Verzosa said.
